I want to retire. Can I stop paying spousal support?

I often get this question from my clients, many of whom are approaching retirement age and have the opportunity to retire and receive their full pension. If you  continue to work until you are 65 and then retire, it is likely that at age 65 you will be entitled to  reduction, if not a complete termination of spousal support. There are many factors that will determine this, not the  least of which is the  income of  your spouse.

If you retire before age 65 (even if you are entitled to and will be eligible to receive a full pension), you run the risk of having a court decide that the fact you are retiring will not be  grounds to reduce or terminate your support.

Bottom line is that if you are contemplating retiring and want to stop or reduce your support payments, you need to review  your situation with a lawyer before making any decision.
